These Terms & Conditions (the “Terms”) govern your access to and use of berretthomeservices.com (the “Site”), our customer portal, and any services we provide at your home or property (collectively, the “Services”). By accessing the Site, booking an appointment, signing a work order, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Plain‑English summary (not a substitute for the full Terms): You book service, prepare the area, and pay as agreed; we’ll perform work in a professional manner consistent with industry standards and any written service plan or work order. Certain services include limited warranties/retreatments described on your paperwork. We limit our liability as described below, and disputes are resolved individually (arbitration/class‑action waiver) unless you opt out.

2) Scope of Services
We provide residential home services such as pest control and related offerings, as listed on the Site from time to time. The specific scope, pricing, frequency, and materials for a visit are set out in your work order, service plan, estimate, or invoice (collectively, the Service Documents). If a conflict exists, the Service Documents control over these Terms for that particular job.
3) Scheduling, access & safe work conditions
- Access: You authorize us to access the service area(s) on your property on the scheduled date. If locked gates, aggressive animals, or other hazards prevent access, a missed‑visit fee may apply.
- Preparation: You are responsible for reasonable preparation (e.g., decluttering, cleaning, moving items as advised). For pest services, follow pre‑ and post‑treatment instructions we provide (e.g., pet/child re‑entry intervals, covering aquariums, protecting food/contact surfaces).
- Rescheduling/Cancellation: Please provide at least 24 hours’ notice to reschedule or cancel. A $49 late‑cancellation or no‑show fee may apply. (Adjust amount as desired.)
4) Estimates, pricing & payment
- Estimates: Any estimate is based on information available at the time and is not a final price. If conditions differ (e.g., severity, structure size), we will discuss changes before proceeding.
- Payment terms: Payment is due upon completion unless otherwise stated in the Service Documents. We accept the payment methods shown at checkout or on your invoice. You authorize us and our payment processor to charge your selected method for one‑time or recurring plan payments.
- Past‑due balances: Unpaid balances may accrue a late fee as allowed by law. We may suspend service until payment is made. You agree to pay reasonable costs of collection, including attorney fees, where permitted.
- Financing: We may offer financing through third‑party partners. Financing is subject to the partner’s approval and terms, which govern that arrangement. We receive limited information necessary to schedule work and record payments.
5) Service‑specific warranties & exclusions
- Limited warranties/retreatments: Certain services include a limited warranty or retreatment period described in the Service Documents (for example, a specified number of days for a follow‑up). Warranties do not apply where instructions are not followed, where conditions conducive to issues remain unaddressed (e.g., leaks, entry points, sanitation), or where third parties alter treated areas.
- Exclusions: Unless expressly included in the Service Documents, we do not provide structural repairs, mold remediation, wildlife removal, roof work, landscaping, or remediation of pre‑existing damage. Termite or wood‑destroying organism treatments are subject to service‑specific terms and often require separate agreements.
- Materials & substitutions: We may use equivalent materials if listed products are unavailable, provided efficacy and safety are substantially similar and compliant with label and law.
6) Health, safety & environmental notices (pest services)
- All pesticide applications follow the product label, which is the law. You agree to comply with label‑based re‑entry intervals and safety guidance we provide.
- Inform us in advance of any sensitive individuals, pets (including fish/reptiles), or special conditions (e.g., pregnancy, respiratory sensitivities) so we can adjust methods.
- Keep children and pets away from treated areas and products as instructed.
7) Customer responsibilities
- Provide accurate information about the property and problem.
- Maintain reasonable sanitation and exclusion measures (e.g., sealing entry points, reducing standing water, trimming vegetation away from structures) as advised.
- Follow preparation and aftercare instructions. Failure to do so may void warranties/retreatments.
8) Photos, videos & device data
We may document service conditions with photos/videos for quality, training, warranty verification, and recordkeeping. We may also use anonymized device/usage data from the Site and customer portal per our Privacy Policy. We do not publish identifiable images of your home without consent, except as required by law or to protect rights.
9) Intellectual property; Site license
The Site, its content, trademarks, and software are owned by us or our licensors and protected by law. We grant you a limited, revocable, non‑transferable license to access and use the Site for personal, non‑commercial purposes. You may not copy, modify, distribute, or create derivative works without written permission.
10) Prohibited activities (Site)
You agree not to: (i) violate laws; (ii) attempt to gain unauthorized access to the Site or accounts; (iii) interfere with the Site’s operation (e.g., scraping, automated access beyond robots.txt, or introducing malware); (iv) misrepresent your identity; or (v) use the Site for competitive intelligence in breach of any applicable agreement.
11) Third‑party sites, tools & portal
The Site may link to third‑party portals (e.g., customer account management, payments, financing). Those providers operate under their own terms and privacy policies, which govern your use of their services.
12) Disclaimers
- General: EXCEPT AS EXPRESSLY STATED IN THE SERVICE DOCUMENTS, THE SERVICES AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT.
- Outcomes: Pest/infestation pressure can vary due to environment, weather, neighboring properties, and property conditions. No service can guarantee permanent elimination of all pests or future activity.
13) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE/GOODWILL. SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR INCIDENTAL/CONSEQUENTIAL DAMAGES; THESE LIMITATIONS MAY NOT APPLY TO YOU.
14) Indemnification
You agree to defend, indemnify, and hold harmless Berrett and its officers, employees, and contractors from and against claims, damages, costs, and expenses (including reasonable attorney fees) arising out of your breach of these Terms, your misuse of the Site/Services, or your violation of law.
15) Text messaging & electronic communications
- Consent: With your consent, we may send SMS/MMS messages for appointment confirmations, technician ETAs (which may include a photo), service updates, and limited promotions.
- Opt out: Reply STOP to cancel; HELP for help. Message frequency varies. Message/data rates may apply. Carriers are not liable for delayed/undelivered messages. Consent is not a condition of purchase.
- E‑sign: You consent to transact electronically, receive disclosures electronically, and sign agreements electronically.
16) Privacy
Our collection and use of personal information are described in our Privacy Policy, which is incorporated by reference into these Terms.
17) Force majeure
We are not responsible for delays or failures due to events beyond our reasonable control, including extreme weather, labor shortages, supply interruptions, utility failures, or acts of government.
18) Governing law; venue; dispute resolution
- Governing law: The laws of the State of Texas govern these Terms and any disputes, without regard to conflict‑of‑laws rules. (Change if you prefer.)
- Informal resolution: Contact us first; most issues can be resolved quickly.
- Arbitration & class‑action waiver: Any dispute not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You and we waive the right to a jury trial and to participate in a class or representative action.
- Opt‑out: You may opt out of arbitration/class waiver within 30 days after you first accept these Terms by mailing a notice to the address in Section 1 with your name, service address, and a statement that you opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in Dallas County, Texas (venue and jurisdiction consented).
- Small claims: Either party may bring an individual action in small claims court in a county where you reside or where our office is located.
19) Changes to the Services or Terms
We may update the Site, Services, or these Terms from time to time. Changes take effect when posted to the Site with the “Last updated” date above. For material changes to dispute resolution, we will provide additional notice as required by law.
20) Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
21) Entire agreement; severability; no waiver
These Terms, together with the Service Documents and Privacy Policy, are the entire agreement between you and us regarding the Services. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.
22) Notices
We may provide notices via email, SMS, postal mail, or by posting to the Site. You are responsible for maintaining up‑to‑date contact information.

- Termite/Wood‑Destroying Organism — inspection scope, treatment method, warranty coverage/exclusions, and damage limitations.

- Attic/Insulation or Entry‑Point Exclusion — materials, scope limits, rodent proofing details, and sanitation expectations.
- Emergency/One‑Time Service — trip fees, after‑hours rates, and limitations.
Keep these addenda with your work orders and link them from the Site. Service‑specific terms control for that service.
